The Consumer Protection Act 2019 introduced strict product liability. Under Sections 82–87, manufacturers, distributors, and product service providers are liable for personal injury or property damage caused by defective products — without proof of negligence.
The manufacturer, importer, dealer, and product service provider may all be liable under the Consumer Protection Act 2019. This is particularly relevant where the original manufacturer is foreign — the importer and retailer carry joint liability.
Compensation includes: medical expenses; loss of income; pain and suffering; punitive damages where the defect was known; and property damage. The Act allows courts to award compensation that serves as an effective deterrent.
Failure to effectively notify consumers of a product recall is itself a ground for enhanced liability. We pursue enhanced compensation where manufacturers knew of defects and failed to protect consumers.
