Yes. Section 354A of the BNS 2023 makes various forms of sexual harassment criminal offences. The POSH Act additionally provides a civil complaint mechanism through the ICC with remedies including compensation and service-related actions.
A POSH complaint must be filed within 3 months of the incident. The ICC may extend this by a further 3 months if satisfied that exceptional circumstances prevented timely filing.
The POSH Act is specifically for women at the workplace. Male employees who experience harassment may pursue remedies under the BNS, general civil law, or company grievance mechanisms.
Preventive measures include: anti-discrimination policies; properly training the ICC; regular POSH awareness sessions; anonymous grievance mechanisms; pay equity audits; and documented promotion and termination decisions.
